MINUTES

Call to Order

Hatfield called the meeting to order at 10:36 a.m.

Quorum was established.

Introductions were made.

Approval of Minutes

Motion by Purdy to approve the open and closed session minutes of March 17, 2022.

Seconded by Duneman.

Vote:     Aye:       All                           Nay:       None                     Abstaining:         None

Motion passed.

Complaints & Discipline

Closed Session 1:

Motion by Duneman to enter into closed session pursuant to Iowa Code section 21.5(1)(a), (d), & (f) and 272C.6(4) at 10:38 a.m. to review pending licensee discipline cases and investigations, including any cases ready for final resolution through closure or consent order.

Seconded by Purdy.

VOTE: Roll call: Brannaman, aye; Duneman, aye; Hatfield, aye; and Purdy, aye.

Motion passed.

Open Session 2:

Motion by Brannaman for the Board to return to open session at 10:58 a.m.

Seconded by Duneman.

Vote:     Aye:       All                           Nay:       None                     Abstaining:         None

Motion passed.

Formal Hearing

Case No. 22-01

All public members, with exception of Pecord, were placed in the waiting room at 11:10 a.m.

A hearing was held before the Board in Case No. 22-01.  Administrative Law Judge Kathleen O’Neill assisted the Board in conducting the hearing and a certified court reporter recorded the proceedings with the Respondent present via telephone.  The hearing was closed to the public, pursuant to Iowa Code section 272C.6(1).  Hearing commenced at 11:10 a.m. and concluded at 11:50 a.m.

Hatfield called for a break from 11:50 a.m. until 12:01 p.m.

Barrett was placed in the waiting room at 11:50 a.m.

Closed Session 2:

Motion by Hatfield to enter into closed session pursuant to Iowa Code 21.5(1)(f) to deliberate Case No. 22-01.

Seconded by Purdy.

VOTE: Roll call: Brannaman, aye; Duneman, aye; Hatfield, aye; and Purdy, aye.

Motion passed unanimously.

The board entered into closed session at 12:02 p.m. and arose from there at 12:56 p.m.

Open Session 3:

Motion by Purdy to return to open session at 12:56 p.m.

Seconded by Duneman.

Vote:     Aye:       All                           Nay:       None                     Abstaining:         None

Motion passed.

Motion by Hatfield to request that Administrative Law Judge O’Neill prepare a written decision for IAEB Case No. 22-01 in accordance with the findings and deliberations made in closed session.

Seconded by Purdy.

Vote:     Aye:       All                           Nay:       None                     Abstaining:         None

Motion passed.

Board Member Reports

The board members had nothing to report.

The board reviewed the written reports in the board drive and had no questions or comments.

Staff Reports

Assistant Attorney General: Barrett had nothing to report.

Board Executive/Bureau Chief: SchraderBachar asked members to have their per diem and travel vouchers signed and returned to her. SchraderBachar showed the board how to access board information in the drive. SchraderBachar noted that she uploaded to the Google drive: an article from FARB Focus Newsletter titled Random Thoughts from a Public Protection Administrator and the brochure Board Member Dos and Don’ts for all members to review. She reported renewals have been going well so far.

Licensing Specialist: Gleason reported that from March 1, 2022 through April 30, 2022 there were 35 new licensees and 6 reinstatements in addition 1,202 licensees were eligible for renewal.

NCARB

NCARB Annual Meeting: Officers & Resolution Discussion

SchraderBachar verified the attendees for the meeting. Brannaman requested input for the election votes for the NCARB Annual Meeting.

Election of Officers

Motion by Brannaman to elect Hatfield as chair and Duneman as vice-chair.

Seconded by Purdy.

Motion passed.

Establish Rules Committee

SchraderBachar reminded board members of the 5-Year Rolling Rules Review and the board requested an open meeting to review the rules.

Motion by Brannaman for the Board to return to open session at 1:37 p.m.
